Privacy Policy - nuNight Entry App

Your privacy is important to us. This Privacy Policy explains how the nuNight Entry App handles your data when you use our app. We are committed to protecting your information and complying with applicable data protection laws, including the General Data Protection Regulation (GDPR) and the Swiss Federal Act on Data Protection (nFADP).

1. Data We Collect

We do not collect any personal information (such as your name, email address, or location) from you as a user of the app. The only data we collect from your device is:

• MAC Address: A unique identifier assigned to your device's network interface.
• Operating System (OS) Version: The version of the operating system running on your device.
• Device Name: The name you have assigned to your device (e.g., "John's Phone").
• Last Communication Timestamp: The time and date when the app last connected to our service and synchronized data.
• Check-in Status and Time (whether a guest has checked in or not including the date and time)

In addition, the app temporarily downloads and processes guest data for the purpose of event check-ins. This includes the following types of personal data:

• First Name and Last Name of guests
• Date of Birth (if available)
• What list the guest is on (i.e. 'Lounge List', 'Free Entry', etc.)
• Guest membership status (including membership ID and expiry date)
• Details of any lounge reservations (including associated guests and reserved lounges)

This guest data is downloaded from the nuNight Management System and is handled temporarily for the purpose of facilitating guest check-ins. The app does not collect personal data directly from guests, other than their check-in status and time.

2. How We Use the Data

The data we collect is used solely for the following purposes:

• Device Identification: The MAC address and device name allow us to identify and connect your device to our service.
• Compatibility: The OS version helps us ensure that the app works correctly on your device.
• Synchronization Tracking: The last communication timestamp helps us track when the app last synchronized data with our service to ensure smooth operation and troubleshooting.
• Guest Check-in: Guest data is used temporarily to facilitate check-ins at events, track memberships, and confirm reservations. The time and status of check-ins is uploaded to the nuNight Management System for further processing.

The app does not use any of the data for other purposes, such as analytics, marketing, or advertising. The check-in data that is synchronised to the nuNight Management System before deletion may be used for analytics and marketing purposes in accordance with the nuNight Management System - Privacy Policy.

3. Data Storage and Retention

All personal data related to guests and check-ins is temporarily stored on your device for the purpose of the event check-in. This data is automatically deleted when:

• The event has ended
• The app is disconnected from the service
• The app is uninstalled from your device

The app does not retain guest or check-in data after the event is over, ensuring that the data is only used for its intended purpose and automatically deleted promptly in compliance with GDPR and nFADP principles. Synchronized check-in data is retained by the nuNight Management System in accordance with the nuNight Management System - Privacy Policy.

4. Guest Data Processing

Although our app processes guest data temporarily, it does so solely for operational purposes (i.e., checking in guests at events). This data is provided by the nuNight Management System that collects and manages guest information. The handling and protection of that personal data are subject to the nuNight Management System's privacy policy, which should be consulted for full details.

Our app does not share guest data with any other third parties and ensures that the data is processed securely during the time it is stored on your device.

5. Legal Basis for Data Collection

Under GDPR (EU Users):

We rely on legitimate interest as the legal basis for collecting and processing your device’s MAC address, OS version, device name, and the last communication timestamp, as this information is essential for the proper functioning of the app. Guest and check-in data is processed based on the legitimate interest of conducting the event check-in process, which is supported by the nuNight Management System privacy policy.

Under nFADP (Swiss Users):

We collect and process this information in compliance with Article 13 of the nFADP, which allows for the collection of non-personal data necessary for the performance of a contract or service. Guest data is processed in line with contractual obligations between the event organizer and the guests, as facilitated by the nuNight Management System.

6. Data Security

We implement industry-standard security measures to protect the personal data temporarily processed by the app. This includes the encryption of guest data while it is stored on your device. Guest and check-in data is automatically deleted after its intended use to ensure privacy and security.

7. Sharing and Disclosure of Data

We do not share, sell, rent, or otherwise disclose the data collected by the nuNight Entry App to third parties. However, once check-in data is synchronized with the nuNight Management System, it may be processed or shared with third parties as outlined in the nuNight Management System privacy policy

8. Your Rights Under GDPR and nFADP

Under both the GDPR and nFADP, you have the following rights with respect to your data:

• Right to Access: You can request access to the data we collect.
• Right to Rectification: You can request the correction of any inaccuracies in your data.
• Right to Erasure: The app does not retain personal data after an event is completed, so this right applies only if data is not deleted as expected. The check-in status and time data that is synchronized with the nuNight Management System is subject to data erasure rights, as outlined in the nuNight Management System privacy policy
• Right to Restriction of Processing: You can request that we restrict processing of your data in certain situations.
• Right to Data Portability: While the app does not collect personal data directly, the check-in status and time that is synchronized with the nuNight Management System is subject to data portability rights, as outlined in the nuNight Management System privacy policy

9. International Data Transfers
